Mediation is a voluntary, confidential process in which a neutral third party (the mediator) facilitates communication and negotiation between disputing parties. The mediator does not act as a judge or legal advisor and does not impose decisions on the parties.
The information provided on this website and during the mediation process does not constitute legal advice. HSM Mediation & ADR strongly recommends that all parties obtain independent legal advice before, during, and after the mediation process. Nothing on this website or in our services creates a solicitor-client or legal advisory relationship.
Participation in mediation through HSM Mediation & ADR is entirely voluntary. Any party may withdraw from the mediation process at any time without penalty. No party is obligated to reach an agreement, and the mediator will not pressure any party to accept any particular outcome.
All information disclosed during the mediation process — including but not limited to documents, communications, discussions, and any agreement reached — is strictly confidential. This information may not be disclosed to any third party without the written consent of all parties involved, except where required by law.
The mediator will not disclose any confidential information to any party, court, or third party, except as required by applicable law or professional obligations.
Fees for mediation services are agreed upon prior to the commencement of sessions. All fees are due and payable as specified in the invoice issued by HSM Mediation & ADR. Applicable taxes, including HST (15%) as required under Nova Scotia provincial tax regulations, will be added to all invoices.
Failure to remit payment by the due date may result in the cancellation or rescheduling of mediation sessions. HSM Mediation & ADR reserves the right to suspend services pending payment.
Parties wishing to cancel or reschedule a mediation session must provide at least 48 hours' written notice. Failure to provide adequate notice may result in forfeiture of session fees. HSM Mediation & ADR reserves the right to cancel or reschedule sessions at its discretion with reasonable notice to all parties.
To the fullest extent permitted by applicable law, HSM Mediation & ADR, its mediators, staff, and agents shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use of our services or this website, including but not limited to any loss of agreement, financial loss, or reputational damage.
HSM Mediation & ADR does not guarantee that mediation will result in a resolution and accepts no responsibility for outcomes reached or not reached during the mediation process.
